“It’s something that you know, as a parent, is probably your worst nightmare” Kirby O’Laughlin, neighbor of the family, said after finding out the 11-year-old boy across the street killed his five-year-old little brother.
In a city just outside of Denver, on March 10 a little while after five p.m. authorities responded to a five-year-old little boy’s death. It was later concluded by the Arapahoe County Sheriff’s Office that the boy’s older brother was the cause of the young boy’s death. Both identities of the two brothers are being withheld from the public due to them still being minors. Other details and information about the cause of death were not released to the public.
However, it is known that as of Wednesday, March 11 the 11-year-old boy was taken into custody at the Marvin W. Foote Youth Services Center. ‘While this minor is being accused of a very serious crime, they are still a child, they are still a minor, and those protections are paramount,” ABC News legal analyst Brian Buckmire said. Considering that in the United States a minor can indeed be charged with first degree murder and kids ages as young as 10 to 14 can be moved to adult court if it is for murder charges. However, whether they are tried as a juvenile or an adult depending on the state’s laws, the age of the minor, and the intensity of the crime.
As of Monday, the boy was charged with first-degree murder and an aggravated juvenile offender sentence enhancer. This was confirmed, days after the murder by the 18 Judicial District Attorney’s Office.
